Introduction
The Terms and Conditions, Privacy Policy and Accetable Use Police (“AUP”) forms part of the Agreement between the Client and Iteology CC and is binding on Clients using Iteology CC’s services. The AUP sets out in detail what forms of conduct Iteology CC regards as unacceptable on the part of its Clients and the steps which Iteology CC may take in response to unacceptable use of its services. Please take the time to acquaint yourself fully with the provisions of this Policy.
By contracting with Iteology CC for services, the Client agrees, without limitation or qualification, to be bound by this Policy and the terms and conditions it contains, as well as any other additional terms, conditions, rules or policies which are displayed to the Client in connection with the Services.
Terms of use of Iteology Support Services
While Iteology CC reserves the means to support you and cover our services with the best quality we are able to afford please recognise that should you not have signed any agreement with Iteology that our terms and conditions apply for all our services that are able to be supplied without contract as follows:
Key:
- SLA: “Service Level Agreement”
- Iteology: “Iteology CC”
- Adhoc: “Ad hoc IT Support”
- Client: the “user” or “company” that utilises our services
- other information relevant to customer surveys and/or offers
General:
- Iteology cannot be held for data loss and/or damages of any kind regardless of the cause including our own negligence.
- Our work is guaranteed insofar that the work delivered is not modified by the end user, and only for one business day.
- All use of our services are done so where the client is licensed. Iteology will not work on unlicensed hardware and/or software.
- The client indemnifies Iteology for all work undertaken without a signed agreement.
ADHOC:
- Any adhoc work commenced is billable to the client and payable within 7 days of the invoice presented.
- After hour rates are twice the business hour rate (Adhoc and/or SLA).
- Adhoc support services are on availability of our technicians and all SLA’s in place take priority.
Internet And/Or Cloud Services:
- The client agrees that should our services be utilised that the client will not abuse such services as per the terms of conditions of our suppliers which, on request, can be provided. Such abuse includes, but not limited to:
- Unauthorised marketing and/or spamming;
- Illegal downloading;
- Porn services of any kind;
- Our work is guaranteed insofar that the work delivered is not modified by the end user, and only for one business day.
- All use of our services are done so where the client is licensed. Iteology will not work on unlicensed hardware and/or software.
- The client indemnifies Iteology for all work undertaken without a signed agreement.
Development:
- All development is subject to a quote.
- Any development don whether software or web based is the sole property of Iteology unless otherwise agreed to in writing.
- Any development is ceased should the hours of development exceed the quoted amount.
- No refunds are accepted in development projects for work already carried out.
Billing:
- The Client agrees that they will provide all correct and full information for the entity to be billed for our work.
- Any invoice unpaid invoice after 7 days, Iteology reserve the right to hand over the account to a legal collections company and the customer will be liable for the amount in full, including interest and legal fees to collect the outstanding amounts. Such legal firm may also report the client to a credit bureau at their discretion.
- The customer agrees that our fees and rates may change without notice.
- Returns are subject to inspection by our suppliers. Should our supplier accept a return, any penalties of the return shall be covered by the client.
- Where a return is rejected by our supplier, the same rejection is accepted by our client.
- Should a return incur a cost, the client accepts to cover the same.
